6. The transfer of personal data that the Federal Intelligence Service has
obtained from telecommunications monitoring for its own objectives
to other government authorities is consistent with Article 10 of the Basic Law; it must, however, comply with the following prerequisites: (1)
the data is necessary for the receiving agency's objectives; (2) the requirements placed on changes of objective as set forth in BVerfGE
(Decisions of the Federal Constitutional Court) 65, p. 1 (at pp. 44 et
seq., 62) are met; and (3) the statutory thresholds for transfer comply
with the principle of proportionality.
